Dr. hab. Maciej Bernatt, prof. UW


Maciej Bernatt is an Associate Professor of Law at the University of Warsaw (profesor uczelni). He holds a Habilitation, PhD and MA titles in law and a second MA title in international relations (political sciences). Maciej is the director of the Centre of Antitrust and Regulatory Studies and a head of the Department of European Economic Law, Faculty of Management, University of Warsaw. He is also the Editor-in-Chief of the Yearbook of Antitrust and Regulatory Studies and the director of ASCOLA Central Europe Chapter. He held visiting fellow appointments at the University of Melbourne, the Max Planck Institute for Innovation and Competition (Munich), the UNSW (Sydney), and the Loyola University Chicago. At the University of Warsaw he teaches EU economic law, competition law, as well as course in business and human rights. He has received scholarships and research grants from several institutions, including Polish-U.S. Fulbright Commission, the Max Planck Institute for Innovation and Competition, the Polish Minister of Science and Higher Education, the Polish National Science Centre, the Foundation for Polish Science, the Polish National Agency for Academic Exchange. In the past he worked as a référendaire in the Polish Supreme Court and in the Constitutional Tribunal of Poland as well as in the Helsinki Foundation for Human Rights, where he coordinated the Strategic Litigation Program. He has been involved in cases litigated before the European Court of Human Rights and Polish courts. He has lectured at universities in Poland, the USA (Loyola University Chicago) and Ukraine (Ivan Franko National University, Lviv).
Maciej’s areas of interest include competition law, administrative law, constitutional law, and EU law, with a focus on enforcement of competition law and protection of fundamental rights (especially the right to a fair trial), as well as business-human rights relations. He has published two books and numerous articles in Polish journals. He is also a co-author of two leading commentaries to the Polish Competition Act and Polish Unfair Competition Act. His publications in English appeared in, inter alia, the Common Market Law Review, the European Law Review, the Journal of Antitrust Enforcement, the Columbia Journal of European Law, World Competition, and the Review of European Administrative Law.

    The Limits of Judicial Assessment in Competition Law, National Science Centre research grant (Sonata 8, decision no. 2014/15/D/HS5/01562); duration: 3 years (2015-2018). I was a leader of the international research group I established (Ondrej Blazo - Comenius University Bratislava; Borbala Domotorfy, Stella Simon - Pazmany Peter Catholic University, Budapest). The aim of the project is to establish under what conditions the court is entitled to defer to competition authorities’ findings. The constitutional standards which govern judicial review in competition law as well as case-law in competition law cases are analysed.
    Embracing and Nurturing the Free Market: Lessons from Poland through the Lens of Competition Law and Policy, research under the grant awarded to Dr Marek Martyniszyn (Queen’s University Belfast, principal investigator) by Oxford Noble Foundation; duration 2017-2018. The project investigated the embracement and development of a free market economy in Poland following the fall of communism through the lens of Competition Law and Policy; it included in-depth interviews (with all former heads of the Polish competition agency, judges & practitioners) and the analysis of data and statistics (also secured via freedom of information requests).     Application of EU Competition Law by National Competition Authorities in the CEE Region. Together with co-investigators from abroad: M. Botta (University of Vienna) and A. Svetlicinii (University of Macau) I have been conducting a research project (since September 2014) concerning the application of EU competition law in Central and Eastern Europe. My participation in the project is financed from the University of Warsaw public research grant.
    Transposition of EU Private Damages Directive. I take part in a network academic project concerning the transposition of Directive 2014/104/UE of 26 November 2014 on certain rules governing actions for damages under national law for infringements of the competition law provisions of the Member States and of the European Union led by B. Rodger (University of Strathclyde), M. Sousa Ferro (Universidade de Lisboa) and F. Marcos (IE Law School Madrid); together with M. Gac I am responsible for research on transposition of the Directive in Poland. Our research report will be published in 2018 by Oxford University Press in the book The EU Antitrust Damages Directive: Transposition in the Member States, B. Rodger, M. Sousa Ferro, F. Marcos (eds.).
    Fines in competition and consumer law. I acted as a co-ordinator of the research project of the Centre for Antitrust and Regulatory Studies commissioned by the Polish Competition Authority (November 2015 to May 2016). Its main goal was to analyse case-law concerning fines and factors that influence the level of those fines. As part of the project I prepared the study entitled Premises of the amount of fine in the Competition Act. I consulted the research questions and goals as well as final reports.
    A versenyjogi kikényszerítési rendszer reformjának alapvető kérdései [Fundamental principles of competition law enforcement]. I took part in the research project of the Pázmány Péter Catholic University, No. KAP-1.1-14/035, dedicated to fundamental rights in competition law. I prepared the study on the role of Article 6 ECHR in competition proceedings.
    Judicial Review in U.S. Antitrust Law. While in the U.S. (Fulbright Scholarship, October 2013 to June 2014) I ran a project in the Institute for Consumer Antitrust Studies, Loyola University Chicago School of Law on judicial review of administrative action in the U.S. with special focus on the judicial review of the FTC decisions. My research involved consultations with the professors of New York University, Columbia University, Loyola University Chicago, DePaul University as well as with representatives of the FTC and the American Antitrust Institute.
    Corporate social responsibility. Employee perspective. I took part in the three-year project (2011-2013) conducted by the Trade Unions Forum and the Faculty of Management of the University of Warsaw financed from EU funds (Human Capital Program; POKL/2.2/2010). I acted as one of four experts as well as co-author of the report book describing the results of the first, qualitative part of the project (Raport z badań. Społeczna odpowiedzialność biznesu - perspektywa pracownika, K. Klincewicz (ed.), Warszawa – Bydgoszcz: Forum Związków Zawodowych i Wydział Zarządzania UW, 2013. I was one of the originators of this project.
    Airport Services in EU and in Poland – competition law and regulatory aspects (II). I took part in the research project of the Centre of Antitrust and Regulatory Studies commissioned by ‘Polish Airports’ State Enterprise (PPL), 2011-2012. I was responsible for the analysis concerning human rights aspects of airport services.
